Chem Tales: Reefer Sadness as Jeff Sessions Declares War on Pot

Part of their argument was that running elections is the business of the states, not the federal government.

The Back Porch, a "Premier Cannabis Retailer" in Wenatchee says they're not too anxious about Sessions revoke of the Cole Memo.

Although California governor Jerry Brown has talked about starting a state-chartered bank to serve the marijuana industry, at the moment sellers are limited to all-cash transactions.

Cole had ordered the memo out of respect of the Traditional allotment of the several drug-enforcement responsibilities that the states have when the regimes in the state are not following the federal priorities.

Scott's spokeswoman, Lauren Horwood, said he declined to comment on the most recent federal move.

Gov. Tom Wolf also criticized the Trump Administration's decision that essentially negates the Obama administration's policy of non-interference with marijuana-friendly state laws.

They argue that Sessions is trampling on the rights of states that have made a decision to legalize pot for medical or recreational use, or both.

In November, a federal judge issued an injunction blocking Trump's executive order that had directed the government to make sanctuary cities ineligible for federal grants. Asked about the president's position Thursday, White House spokeswoman Sarah Huckabee Sanders said he supports enforcing federal law.

Sessions, though, said the previous policy "undermines the rule of law".

Maryland has licensed dozens of medical cannabis growers, processors and dispensaries. On the heels of Sessions' announcement, cannabusiness stocks slipped sharply as well.

In California's Eastern District, newly sworn-in U.S. Attorney McGregor "Greg" Scott grew up in Humboldt County, deep in California's famed "Emerald Triangle" marijuana-growing region. Consequently, he said he believes we will likely see more tourism-related businesses embrace it.

There are some exceptions to this new law for certain medical marijuana patients.

That amendment has been put into federal spending bills, preventing the federal government from using its resources to stop states from implementing medical marijuana programs, said Kate Bell, legislative counsel for the Marijuana Policy Project.

Walsh, the former US attorney for Colorado, said sitting and incoming top federal prosecutors in pot-friendly states should rely on their staffs, who have years of experience investigating cases, to put marijuana in context with other priorities.

Medical marijuana in Pennsylvania is approved for use of PTSD.

Many politicians, including Republicans, have cast Session's move as an infringement on states' rights. Harris has been a longtime opponent of legalizing marijuana and fought the legalization of the drug in Washington.

Today's federal drug laws are rooted in the 1970 Controlled Substances Act under President Richard Nixon. It is illegal to obtain medical marijuana without a prescription, and with Sessions ordering prosecutors to pursue harsh sentences against offenders of recreational marijuana, then more strain will be placed on the judicial system and prisons.

The Justice Department move plunges the recreational pot markets in states such as Colorado, California, Oregon and Washington into further uncertainty, and was met with a stinging bipartisan backlash from lawmakers in those states where marijuana is sold to any adult who wants to buy it. "This decision reinforces our outdated and destructive policies on marijuana that turn everyday Americans into criminals, tear families apart, and waste billions of taxpayer dollars to arrest, prosecute, and incarcerate people for nonviolent marijuana charges".

Many retired members of the armed forces use medical marijuana as an alternative to opioid painkillers that are commonly prescribed to treat chronic pain and other conditions stemming from their service.
