Cosby prosecutor undeterred by mistrial, vows to try again

After six days of deliberation, the case has ended in a mistrial and Cosby will walk away a free man.

Little testimony about other accusations against Cosby was allowed in the Pennsylvania trial because of the strict standards for admitting evidence in criminal cases.

"We have made the determination of moving forward, and it lies in the fact she deserves a verdict in this this case ... and we will push forward to try and get justice done", Prosecutor Kevin Steele said during a press conference shortly after the legal announcement was made.

Stay tuned on this one. "Mr. Cosby is fortunate he is able to afford good counsel and has resources to conduct investigations".

Constand told prosecutor Kristen Feden she was unable to stop the sex attack because her body was "limp" - the result, she claimed, of the unidentified pills Cosby suggested she take to help her "relax". How do I describe the judge?

He says he'll retry Cosby on charges the 79-year-old TV star drugged and molested Andrea Constand at his Philadelphia-area home in 2004.

The jurors clearly struggled with their verdict, telling Judge Steven O'Neill on Thursday they were at impasse.

Steele says his office stands "in awe" of accuser Andrea Constand and believes she deserves a verdict.

Cosby, who turns 80 next month, was subdued and seemed nearly dazed when O'Neill declared the mistrial. It must come to a unanimous decision to convict or acquit. "T he prosecution needed 12 for a verdict - the defense only needed one for a mistrial".

Cosby's defense lawyers, however, argued that Constand's account could not be trusted after they pointed to numerous discrepancies in her statements to police in 2005, when she first reported the encounter, which occurred almost a year earlier.

Cosby initially settled with Constand in 2005 when she first reported the sex assault to police and filed a civil lawsuit after then-Montgomery County District Attorney Bruce Castor ruled against prosecuting the case.

But it was Cosby's reputation as a public moralist who urged young people to pull up their saggy trousers and start acting responsibly that prompted a federal judge to unseal portions of an explosive deposition he gave more than a decade ago as part of Constand's civil lawsuit against him.

But the comedian was positive, McMonagle said. "Why are we running from the truth of this case - this relationship?"

The testimony is relevant because Cosby is charged with giving pills to Constand, a former Temple University employee, to incapacitate her before their sexual encounter.

"It's extremely emotional", said Jewel Allison, a NY woman who has said that Cosby assaulted her, as she prepared to leave the courthouse.

No one from Cosby's real or TV families was in court Saturday when the case ended in a mistrial.

"I was frozen", she told the jury last week.

About 60 women have accused Cosby of sexually assaulting them, effectively ending the long career of the entertainer once known as "America's dad" for his role in the 1980s television hit "The Cosby Show".

The comedian's lawyers maintained throughout the trial their client and Constand's sexual relationship was consensual.
