Colorado inmate freed early, jailed again wins release

"Utterly unjust." That's how a Colorado judge describes Rene Lima-Marin's 98-year sentence for robbing two stores, a wrong he's righted after almost two decades.

Lima-Marin, now 38, was sentenced in 2000 for his role in two 1998 video store robberies.

The judge decided Lima-Marin should not be imprisoned, as there is no way to turn back the clock on an early release.

"In effect, after its utter lack of care led to Lima-Marin's premature release and prolonged erroneous liberty, in January 2014 the government chose to compensate for its transgressions by swiftly turning back the clock and returning Lima-Marin to prison", said Samour. Authorities realized the mistake in 2014, and police returned him to prison.

His wrongful release in 2008 was due to an error in paperwork that said Lima-Miran's sentences were to be served concurrently, instead of consecutively according to CNN.

Rene Lima-Marin, 36, was preparing to be released from prison again Wednesday after Arapahoe County Chief District Judge Carlos Samour ordered his release and called his reincarceration "utterly unjust".

Lima-Marin's life, however, was interrupted in January 2014, when a former prosecutor searched for his name in the Department of Corrections' inmate locator and discovered that Lima-Marin's name did not show up. "Not all people who are rehabilitated behave that way".

Taking this lucky second chance to heart, Lima-Marin found employment, started a family, purchased a home, and became an upstanding member of his community, working with young people to help them make good choices for their futures. "Everything has been turned on its head", said Lima-Marin's Denver-based attorney, Kimberly Diego, who added that she is scrambling to find him an immigration attorney.

The ruling, handed down Tuesday afternoon, opened with a quote from Alexander Hamilton that said: "The first duty of society is justice", and went on to criticize state officials, who Samour said acted with "shocking" and "deliberate indifference".

"We're just still waiting and trying to figure out what's going on and how to fight", said Lima-Marin's wife, Jasmine, from their Aurora home.

Diego said Lima-Marin is now being held at the Fremont Correctional Facility in Canon City, Colo., and he could be released in the next day or two. "The judge was very thorough, took a lot of time and gave this case a lot of attention". Diego described his work as "thorough" and that she "could tell he wanted to make sure this was ideal". "We are thankful that he took the time that he did". The governor's office said it will review how the court decision affects the pending clemency application.
